Thank you for choosing LaCorsa! 

Before you start using our services, please read these Terms of Service carefully. By accessing or using LaCorsa, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.

LaCorsa ("the Service") is an enablement platform consisting of websites, mobile apps and other technology (collectively “LaCorsa”), owned and operated by RekTeq, Inc. (“RekTek”, “we”, “us”, “our”), a Delaware Corporation.

Use of LaCorsa

By accessing or utilizing LaCorsa, you agree that you have read, understood, and agree to be bound by these Terms of Use (“TOU” or “Terms”).   ReqTek reserves all rights not expressly given in this Terms of Use.  We reserve the right to temporarily or permanently terminate, suspend, or otherwise restrict your access to LaCorsa without notice and liability if, in our determination, you violate any of these Terms.

Third Party Integrations

You may register for or log into your account using a third-party service, such as Google or Apple (“Third-Party Login Provider”). If you choose this option, you authorize LaCorsa to:

• Access certain information from your Third-Party Login Provider account, as permitted by that provider;
• Use such information to populate your account registration details; and
• Authenticate you using your third-party credentials.

Your use of any Third-Party Login Provider is subject to that provider’s terms and privacy policy. LaCorsa does not control and is not responsible for the practices of any Third-Party Login Provider.

Connected Third-Party Services

You may choose to connect your account with third-party applications, plugins, devices, or websites that integrate with LaCorsa Services, including platforms such as Strava, Wahoo, or Garmin Connect, or other third parties that collaborate with LaCorsa to provide integrated features (e.g., challenge sponsors, media streaming providers, or tracking device services).

If you choose to connect or share information with a third-party service:

• You authorize LaCorsa to exchange relevant information with that third party to enable the integration; and
• You acknowledge that information shared with the third party will be subject to that third party’s own terms, conditions, and privacy policies.

LaCorsa does not control and is not responsible for the content, policies, practices, or data handling of any third party. Your interactions with third-party services are solely between you and the applicable third party.

Fees and Payments

Certain features of the Services are provided free of charge, while others require a paid subscription (“Subscription Features”). These Terms apply to both free and paid features. LaCorsa reserves the right to add, modify, or discontinue any feature—free or subscription-only—at any time.

If you choose to access Subscription Features, you agree to pay the applicable subscription fees and any required taxes. Depending on your location and financial institution, additional charges (such as foreign transaction fees) may apply.

Subscription fees are billed on a recurring basis according to the billing cycle of the plan you select. You agree to pay all fees on time.

LaCorsa may increase subscription fees or introduce new fees upon reasonable notice. Unless otherwise stated, fee changes will take effect on your next billing date following notice.

Certain features of the Group Services may be offered free of charge, while others require a paid group subscription (“Group Subscription Features”). These Terms apply to both free and paid group features. LaCorsa reserves the right to add, modify, or discontinue any group feature at any time.

If you purchase Group Subscription Features, you agree to pay the applicable subscription fees and taxes. Additional charges (such as foreign transaction fees) may apply depending on your jurisdiction and banking provider.

Group subscription fees are billed on a recurring basis according to the selected plan. You agree to pay all fees on time.

LaCorsa may increase group subscription fees or introduce new fees upon reasonable notice. Unless otherwise stated, such changes will take effect on the next billing date following notice.

Payment Methods

To pay any fees, you must provide a valid payment method (e.g., credit card, online payment service, or a third-party platform such as the Apple App Store or Google Play) (“Payment Method”). By providing a Payment Method, you authorize LaCorsa to charge it for all applicable fees.

If you subscribe through a third-party platform (e.g., Apple App Store or Google Play), your payment is processed by that platform and may be subject to its terms and conditions.

You may update or change your Payment Method at any time through your in-app Digital Wallet. If you subscribed through a third-party platform, you must update your payment details directly through that platform.

We process payment information in accordance with our Privacy Policy.

Refunds

Unless expressly stated in these Terms, all payments are non-refundable and non-creditable.

Auto-Renewal

Subscriptions automatically renew at the beginning of each billing period according to your selected plan and will continue until canceled.

To avoid renewal charges, you must cancel your subscription at least 24 hours before the end of the current billing period.

Upgrades and Downgrades

Users may upgrade or downgrade their subscriptions at any time.

Upgrades (Individual Users) - You may upgrade your subscription at any time through the app by navigating to: User Settings > Membership.

Upgrades (Groups) - Groups may upgrade their subscription by contacting their support team.

Downgrades (Individual Users) - You may downgrade your subscription at any time through:
User Settings > Membership.

Downgrades (Groups) - Groups may downgrade their subscription by contacting their support team.

Changes to your plan may take effect immediately or at the start of your next billing cycle, as specified at the time of the change.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. After cancellation becomes effective, you will no longer have access to Subscription Features.

You may resubscribe at any time at the then-current pricing.

Free Trials

LaCorsa may offer free trials at its discretion. Free trials may not be combined with other offers unless expressly stated and will last for the period specified in the applicable promotion.

If you begin a subscription with a free trial, you will be charged the applicable subscription fee at the end of the trial period unless you cancel at least 24 hours before the trial ends.

You may be required to provide a Payment Method when registering for a free trial. LaCorsa may authorize a temporary charge to verify your Payment Method. This authorization may reduce your available balance or credit limit temporarily. You will not be charged if you cancel at least 24 hours before the free trial period ends.Content

During your use of LaCorsa, any data placed by you, including software code, algorithms, or data objects, is considered your content (collectively “User Content”).  You grant to ReqTek a worldwide, transferable, and sublicensable right to store, copy, modify, and process all user content you make available via the platform.  User content is protected by the Data Privacy Policy and will only be made available to other Users on LaCorsa within the Service Usage Conditions listed in these Terms, and does not require any further consent, notice, and/or compensation to you or others.  You are solely responsible for the User Content that you make available via LaCorsa. 

Privacy

As part of your use of LaCorsa, ReqTek may collect usage information related to your navigation and activities.  Such data is considered ReqTek data and is not User data.  ReqTek will maintain such data in accordance with the Data Privacy Policy.

You may remove your data from LaCorsa at any time by deleting your account.  The applicable data will be removed from LaCorsa, except (a) to the extent it has been utilized by others as part of LaCorsa and (b) for the reasonable time it takes to remove from backup and other systems.  Any data created on LaCorsa and not ingested from other locations will remain on LaCorsa. 

You agree that ReqTek is acting as a broker of your User Data on LaCorsa and is not responsible for the policing of your and other Users’ data.  ReqTek cannot guarantee the accuracy, integrity, or quality of User Data and therefore cannot assure the content.  You understand that any loss or damage of any kind that occurs as a result of the use of any User Data is solely your responsibility.  ReqTek is not responsible for any public display or misuse of your User Data.  We do, however, to the extent permitted by law, reserve the right to review any or all User Content in our sole discretion and reserve the right to remove any User Data in whole or in part. 

Service Usage Restrictions

You agree that you will:

1. Abide by and comply with these Terms;
2. Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, export control laws, and regulatory requirements;
3. Comply with all disclosure and data utilization requirements;
4. Maintain your User Data for accuracy and completeness.

You agree that you will not:

1. Act in an unlawful or unprofessional manner in connection with LaCorsa;
2. Post User Data that infringes upon any rights of any third party, including but not limited to any intellectual property rights, privacy rights, and rights of publicity;
3. Post User Data that:
4. is intentionally inaccurate, unreliable, or otherwise harmful to the stated purpose of LaCorsa;
5. may create a risk of any other loss or damage to any person or property;
6. may constitute or contribute to a crime or tort;
7. contains any information or content that is illegal; or
8. contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
9. Disclose information that you do not have the consent to disclose (such as confidential information of others;
10. Copy, use, disclose or distribute any information obtained from the Platform, whether directly or through third parties (such as search engines), without the consent of ReqTek, except for the sharing of Company or User Data made specifically available for sharing through LaCorsa;
11. Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission;
12. Violate the intellectual property or other rights of ReqTek;
13. Post anything that contains software viruses, worms, or any other harmful code;
14. Exchange data in LaCorsa without following the proper review process;
15. Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for LaCorsa or any related technology;
16. Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running LaCorsa;
17. Take any action that imposes, or may impose, at our sole discretion, an unreasonable or disproportionately large load on our infrastructure;
18. Upload invalid data, viruses, worms, or other software agents through the system;
19. Create a User profile that misrepresents your affiliation;
20. Use or attempt to use another’s account;
21. Interfere with the proper working of LaCorsa;
22. Bypass the measures we may use to prevent or restrict access to LaCorsa;
23. Override any security feature of LaCorsa;
24. Interfere with the operation of, or place an unreasonable load on, the system (such as unapproved data analytics);
25. Use or launch any automated system, including, without limits, “robots,” “spiders,” “offline readers,” etc., that accesses LaCorsa in a manner that sends more request messages to the ReqTek servers than a human can reasonably produce in the same period of time by using a conventional online web browser;
26. Collect or harvest any personally-identifiable information, including user or account names, from LaCorsa;
27. Solicit contact information or other personal information from Users you don’t know, without authorization;
28. Rent, lease, loan, trade, sell/re-sell access to LaCorsa or related data;
29. Sell, sponsor, or otherwise monetize LaCorsa;
30. Remove any copyright, trademark or other proprietary rights notices contained in or on LaCorsa;
31. Monitor LaCorsa’s availability, performance or functionality for any competitive purpose;
32. Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of LaCorsa;
33. Overlay or otherwise modify LaCorsa or its appearance; or
34. Use LaCorsa for tasks that it is not intended for.

Our Proprietary Rights

Except for your User Content, LaCorsa and its materials, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos and music (the “ReqTek Materials”), and all intellectual property rights related thereto, are the exclusive property of ReqTek and its licensors. Except as explicitly provided herein, nothing in these Terms will be deemed to create a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any materials or content accessible on LaCorsa. Use of the ReqTek Materials on the Platform for any purpose not expressly permitted by these Terms is strictly prohibited.

You may choose to or we may invite you to submit feedback, comments, questions, and other information about LaCorsa, including, without limitation, about how to improve LaCorsa or our other products. By submitting any such comments, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place ReqTek under any fiduciary or other obligation, and that we are free to disclose your comments on a non-confidential basis to anyone or otherwise use them without any additional compensation to you. You acknowledge that, by acceptance of your submission, ReqTek does not waive any rights to use similar or related ideas previously known to ReqTek, or developed by its employees, or obtained from sources other than you.

Indemnification

You agree to indemnify and hold harmless LaCorsa, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Service or your violation of these Terms of Service.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind. LaCorsa does not warrant that the Service will be uninterrupted, secure, or error-free. We disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event shall LaCorsa be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, lost profits, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising out of or related to these Terms of Service shall not exceed the amount paid by you, if any, for the use of the Service.

Governing Law

The laws of the State of Delaware will govern these Terms, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Delaware for the purpose of litigating all such claims.

Changes to Terms of Service

We reserve the right to modify or update these Terms of Service at any time. We will notify you of any changes by posting the revised Terms of Service on the Service.

Your continued use of the Service after the effective date of the revised Terms of Service constitutes your acceptance of the changes.

General Terms

We may notify you via postings on our system, website, via email, or any other means to the contact address you provide to us. 

You may not assign or transfer any rights and licenses granted hereunder.

These Terms, and any other additional terms incorporated by reference herein or that expressly incorporate these Terms, constitute the entire agreement between you and ReqTek regarding the subject matter hereof. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms, which will remain in full force and effect. No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and ReqTek’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.
